An important question in hiring an attorney is how you will be billed for legal services. We offer two types of fee agreements. We can either represent you for an hourly fee or for a contingent fee. Whether or not we will be able to offer you a contingent fee arrangement depends largely on the type of case.

HOURLY FEE AGREEMENTS

If we enter into an hourly fee agreement, our fees would be billed monthly at the particular billing rate of the attorneys, paralegals and investigators working on your case. Payment on hourly fee cases is due within 30 days of billing. In hourly fee cases, we may require an advance retainer or deposit.

 

CONTINGENT FEE AGREEMENTS

In contingent fee agreement cases, our fees would be billed at the end of the case and would be calculated based on the total amount recovered by judgment, arbitration, mediation or negotiated settlement, including interest on any judgment, before deducting case preparation expenses, medical expenses, or any liens or other claims, which may be chargeable against the recovery. The contingent fee would cover all legal services for the entire case, including trial and, if we believe an appeal is warranted, the appeal also. Contingent fees on any so-called "structured settlement," meaning a series of future payments, would be calculated on the basis of the present value of all payments, and would be payable when the initial cash portion of the settlement is paid.

 

OUT-OF-POCKET EXPENSES

In both hourly and contingent fee cases, the client is responsible for paying out-of-pocket expenses.

Out-of-pocket expenses include court filing fees; travel, depositions, fees and expenses of expert witnesses; and other expenses necessary for the investigation, preparation, and presentation of the case, plus a flat charge to cover telephone, postage and copying expenses. The flat charge will be 1% of the gross recovery but shall not exceed a total of $750. Out-of-pocket expenses in connection with hourly fees would be billed and payable monthly. Out-of-pocket expenses in connection with contingent fees would be billed periodically, and payment would be appreciated to the extent possible without undue hardship to you, recognizing that it may be necessary to wait until the end of the case for payment of out-of-pocket expenses. At the end of the case, regardless of its outcome, you will be responsible for reimbursing us for out-of-pocket expenses.
